A court has stopped Trump from using an old law, the Alien Enemies Act, to deport Venezuelan migrants who he said were linked to gangs.

American politics is always moving. This week, former President Donald Trump is in the news again. A federal appeals court blocked his idea to use a law from 1798 to deport Venezuelan migrants who he claimed were connected to gang activity.

Yes, it’s an old law. It was from a time when people wore wigs and wrote constitutions by hand. Now, over 200 years later, it’s the main point in a big immigration fight.

But the court disagreed with Trump.

This decision could change more than just immigration rules. It might decide if presidents can use old laws to fix current problems.

The Alien Enemies Act is an old law.

This law was created in 1798 when the U.S. was afraid of spies. It let the president arrest or deport non-citizens if America was at war with their country. Back then, it was about keeping the country safe.

Now, America isn’t at war with Venezuela. But Trump’s team said the law should still be used because of gangs like Tren de Aragua, which have spread from Venezuela to other places in Latin America and the U.S.

They said these migrants are a threat to security, so the president should have the power to deport them as if the country were at war.

But the court didn’t agree.

What the Judge Said

Judge Amit Mehta was clear. The Alien Enemies Act doesn’t apply here. It’s for declared wars, not for dealing with immigration issues during peacetime or gang problems.

Since America isn’t officially at war with Venezuela, this law can’t be used to quickly deport people. That’s it.

The judge also warned about something bigger. If presidents can use old laws whenever they want, where does it end? Today, it’s deportations. Tomorrow, it could be watching people, stopping free speech, or something worse.

That’s not how democracy should work. That’s too much power for one person.

Why Trump Wanted To Use It

Trump has always been clear about his views on immigration. From his first campaign to his last days in office, it was a key part of his message: build the wall, stop the gangs, protect American jobs.

The Tren de Aragua gang from Venezuela became a key example in his speeches. They’re violent, organized, and spreading. By linking them to immigration, Trump made his law and order promises seem more important.

Trump’s team wanted to use the Alien Enemies Act to act faster, without having to wait for Congress or deal with debates about immigration reform.

But this court decision stopped that plan.
